Remedial Investigation Deadline Extension Signed into Law

As advised in our January 17, 2014 E-Alert, a bill proposing to extend the deadline for completion of required environmental remedial investigations at subject properties was awaiting final approval by Governor Chris Christie. 

On January 21, 2014, Governor Christie signed Assembly Bill No. A4543, which extends the deadline for completing pending environmental remedial investigations until May 7, 2016.  The New Jersey Department of Environmental Protection (“NJDEP”) will grant an extension if (1) the applicant certifies that it meets specified conditions; or (2) the failure to complete the remedial investigation is due to a delay in the provision of financial assistance from the NJDEP’s Hazardous Discharge Site Remediation Fund.  Applications for an extension must be submitted to the NJDEP by March 7, 2014.
